Terms and Conditions

  1. How to Participate: The Great Canadian Yoga Stretch (the "Campaign") runs from May 1 to May 31, 2010 (the "Campaign Period"). To register as a fundraiser, go to www.greatcanadianyogastretch.ca (the "Campaign Website") beginning on April 12, 2010 and complete the instructions on the website to register and to create your own fundraising page. As part of the Campaign, you will design your own yoga-based challenge, and raise donations from yourself or others to support you for completing that challenge. You may register as an individual, in pairs or in teams.
  2. Eligibility: To participate as a fundraiser, you must be a legal resident of Canada over the age of majority in the province or territory in which you live. Officers, directors, employees, agents and independent contractors of the Canadian National Institute for the Blind (the "CNIB") may participate, but will not be eligible to receive the Thank You Gifts described below.
  3. Fundraising: All funds raised must be donated to the CNIB as per the options outlined on the Campaign Website. All donations must be received by CNIB no later than 5:00 pm ET on Friday, May 28, 2010 for you to be eligible to receive a Thank You Gift. Tax receipts will be issued for individuals and corporations who donate $15 or more; however, tax receipts will not be issued for donations made on behalf of a group of individuals.
  4. Thank You Gifts:

    Celebration Event: All registered participants of the Great Canadian Yoga Stretch will be eligible to attend a Celebration Event held in May or June 2010 in cities advertised on the Campaign Website. Travel to and from the Celebration Event, and all expenses, are the sole responsibility of the participants. The approximate value of Celebration Event attendance is $25 per person as determined at the sole discretion of CNIB; participants who donate to their own campaigns will be eligible for a tax receipt minus the approximate value of the Celebration Event should they choose to attend.

    The Great Canadian Yoga Stretch Retreat: To qualify for this Thank You Gift, you must reach the following applicable fundraising targets: Individuals - $2,000 or more; Pairs of 2 people: -$1800 or more per person; Teams of 4 or more - $1700 or more per person. The approximate value of Yoga Stretch Retreat attendance is $1500 per person as determined at the sole discretion of CNIB; participants who donate to their own campaigns will be eligible for a tax receipt minus the approximate value of the Yoga Stretch Retreat should they choose to attend.

    The Great Canadian Yoga Stretch Retreat will be held at the CNIB Lake Joseph Centre in Mactier, ON from Friday June 18 to Sunday June 20, 2010. Dates and locations subject to change depending on demand and availability. The Great Canadian Yoga Stretch Retreat consists of: (i) one (1) roundtrip economy airfare ticket for each qualifying fundraiser from the Canadian international airport closest to the fundraiser’s primary residence within Canada (airport, carrier and airline ticket class selected at the sole discretion of CNIB) to Pearson International Airport in Toronto; (ii) one (1) roundtrip ground transport from Pearson to CNIB Lake Joseph Centre; two (2) nights’ accommodation at CNIB Lake Joseph Centre; (iii) breakfast, lunch and dinner on Saturday, June 19 and breakfast and lunch on Sunday, June 20; and (iv) group yoga instruction and meditation as provided by CNIB partners, at the discretion of CNIB. Any and all other expenses not expressly included in the description above, including, without limitation, additional meals, ground transportation, airport taxes or fees, telephone, fax, cable or Internet charges, personal services and expenses, insurance, and other incidental costs and any other costs not specifically stated herein as being included, are the responsibility of the qualifying fundraiser.

    Thank You Gifts must be accepted without substitution, and are not transfer able or redeemable for cash. CNIB reserves the right to substitute a Thank You Gift if for any reason it cannot be issued as described herein. The refusal by a participant to accept a Thank You Gift releases and forever discharges CNIB and its agents from all obligations related to the Thank You Gift and will not result in the issuance of a tax receipt. Once booked, travel arrangements may not be changed. CNIB will not be responsible if cancellations, airport security or clearances, or other factors beyond their reasonable control prevent the Thank You Gift or any part of the Thank You Gift from being fulfilled.

    Burt's Bees Offer:The first 10 participants who raise $1,000 or more will be eligible to receive a Burt's Bees gift basket, valued at approximately $200 as determined at the sole discretion of Burt's Bees; participants who donate to their own campaigns will be eligible for a tax receipt minus the approximate value of the Burt's Bees offer.
  5. Personal Information

    CNIB and its authorized agents will collect, use, and disclose the personal information you provide when you register at the Campaign Website, for the purposes of administering the Campaign and issuing a Thank You Gift. By accepting a Thank You Gift, a fundraiser agrees to CNIB’s use of his/her name, city/province of residence, biographical information, statements, voice and likeness in any advertising and publicity CNIB may conduct relating to the Campaign in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice.   6. Limitations of Liability

    BY PARTICIPATING IN THIS CAMPAIGN, FUNDRAISERS AGREE THAT CNIB, ITS PARENT, RELATED AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE "RELEASEES") HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY FUNDRAISERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS OR PROPERTY RESULTING FROM: A) A THANK YOU GIFT, INCLUDING THE ACCEPTANCE, PARTICIPATION IN, MISUSE OR USE OF THE THANK YOU GIFT; B) PARTICIPATION IN THIS CAMPAIGN, INCLUDING ACCESS TO AND USE OF THE CAMPAIGN WEBSITE, OR C) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS OR DEFAMATION.

    Without limiting the foregoing, the Releasees, and any of CNIB's other agencies, suppliers or contractors, shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Campaign Website users, or by any of the equipment or programming associated with or utilized in the Campaign, or by any technical or human error which may occur in the processing of registrations or donations in the Campaign; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, registrations; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from CNIB for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Campaign; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.
  7. Termination

    CNIB reserves the right to terminate, suspend or modify this Campaign, in whole or in part, at any time and without notice or obligation if, in CNIB's sole opinion, any factor interferes with its proper conduct as contemplated by these Terms and Conditions.
  8. Additional Terms

    Receiving a Thank You Gift is contingent on fulfilling all the requirements set forth herein. All registrations and donations are subject to verification. Registrants agree to abide by these Terms and Conditions. Decisions of CNIB will be final and binding on all matters pertaining to this Campaign. Campaign is subject to all applicable federal, provincial and municipal laws. CNIB reserves the right to correct any typographical, printing, computer programming or operator errors. CNIB's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision of the Terms and Conditions is determined to be invalid or otherwise unenforceable, then the Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

    Should a registrant make any false statement(s) in any document referenced above, the registrant will be required to promptly return to CNIB his/her Thank You Gift, or the cash value thereof. CNIB reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the registration process, the operation of the Campaign and/or Campaign Website, violates the Terms and Conditions, or acts with intent to annoy, abuse, threaten or harass any other person.

    WARNING: ANY ATTEMPT BY A REGISTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CAMPAIGN OR UNDERMINE THE LEGITIMATE OPERATION OF THE CAMPAIGN IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND CNIB RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

    In the event of a dispute as to the identity of the person who submitted any registration, the authorized account holder of the e-mail address submitted at registration will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address.
